  • Lawyer: “Gerardo is being punished for something for which he is absolutely innocent” | Cubadebate (English)
    that don t apply to the other four RK One of the principal factors in the case was the law that we were operating under The US government has never tried to prosecute someone as they prosecuted Gerardo not just for the conspiracy to commit espionage which was a unique charge where they had conceded that he had not even attempted to commit espionage or never planned to attempt to commit espionage that nevertheless that somehow they could sustain a conspiracy But apart from the charge which we believe was fundamentally defective with regard to the claim of attributing to a conspiracy to commit murder is just an incredible charge One of the problems with that accusation is that the government had never tried to prosecute somebody under that theory before When the judge tried to restrict their ability to prosecute on a bad theory the prosecutors admitted in an emergency filing in the court of appeals that it would be impossible for them to prove Gerardo guilty under the law as found by the judge What happened then was a very unusual thing Even though the judge had agreed to correctly instruct that the jury was limited to one theory under the law the court of appeals held that the judge didn t successfully instruct the jury of that limitation that the jury was left to pursue other theories and so even though the defense attorney didn t realize it Gerardo was being convicted on theories that he didn t even know were before the jury So the procedures created a situation where the lawyer really felt that he had not defended the case because he thought that the theory on which the case was sustainable was not even before the jury So that s the origin of the realization that we had on our part that the lawyer was unable effectively to defend because he didn t even have the opportunity to know even what the jury was considering as a theory And it is truly a unique theory the government tries to rely on to attribute to Gerardo something for which he had no responsibility whatsoever But beyond that so much additional evidence has come forward with regard to Gerardo s actual innocence and had a lawyer known how the court of appeals would limit his ability to defend the case then clearly he would have presented more evidence of Gerardo s innocence He Paul McKenna readily acknowledges these mistakes readily acknowledges that had he understood the law completely he would have been able to fully present and take on a more affirmative responsibility to prove Gerardo s innocence and which is what he was left with the responsibility of doing even if he didn t know it And that s largely where we are right now He admits that had he understood where the case was going this novel prosecution this unheard of prosecution he would have been able to easily establish Gerardo s actual innocence

    and priorities of the Haitian government we have been tirelessly working to implement a program to rebuild the national health system whose essence lies in satisfying the health needs of 75 of the most needy population with a minimum cost From January 12th of 2010 until today almost 2 million patients have been cared for more than 36 000 surgeries have been performed and almost 8 500 babies have been delivered More than 465 000 patients have received rehabilitation treatment Services are being provided at 23 reference community hospitals 30 rehab wards 13 health centres 2 ophthalmologic surgery posts and the Public Health Laboratory Throughout the 10 departments in the country a Comprehensive Programme for Hygiene and Epidemiology is being developed The cooperation programme promoted by Cuba today has 1 117 health collaborators of which 923 are Cuban and 194 come from the various countries graduating students in Cuba The resources generously provided in solidarity by President Hugo Chávez Frías of the Bolivarian Republic of Venezuela have been essential We have also been working closely with Brazil via a Tripartite Agreement with Haiti Cuba has also received the backing of several countries in order to carry out this health programme Namibia Norway South Africa Australia and Spain have contributed along with group of individual donors something more than 3 5 million dollars We are ready to work in a strictly humanitarian fashion with respect and in full coordination with the Haitian government with any and all countries and organizations which have the will to take part in the rebuilding and development of its health system At the same time Cuban doctors have confronted a serious cholera epidemic For this purpose 67 units were set up looking after more than 73 000 patients a third of all the cases in the country Of these only 272 died for a death rate of 0 37 5 times lower than in the rest of the institutions in Haiti Looking after patients has demanded selflessness and the spirit of sacrifice especially during the nights In the last 77 consecutive days our medical and nursing personnel have seen no deaths due to cholera The creation of Active Survey Groups called Subcomuna Adentro was a new experience permitting the study of almost one million and seven hundred thousand people living in communities without access to health care services and to diagnose more than 5 300 cholera cases in their very own homes I mention these data with all the modesty of our people merely to argue with practical examples in support of our conviction that what Haiti needs is substantial and impartial aid closely coordinated with the government that contributes to its development and to overcome the immense socio economic difficulties and disparities that affect the country and impede stability and progress for its people Haiti does not need an occupation army it is not nor can it become a United Nations protectorate The role of the UN is to support the government and people of

    woman dies every five days as a result of domestic violence In the countries of the South half a million mothers die in childbirth every year Every day 29 000 children die of hunger and preventable diseases In the minutes that I have been speaking no less than 120 children have died Four million perish in their first month of life In total 11 million children die every year There are 100 000 deaths a day from causes related to malnutrition adding up to 35 million a year In Hurricane Katrina alone in the most developed country in the world 1 836 people died almost all of them African Americans with limited resources In the last two years 470 000 people died throughout the world as a result of natural disasters 97 of them of low income In the January 2010 earthquake in Haiti alone more than 250 000 people died almost all of them resident in very poor homes The same thing occurred with homes swept away by excessive rainfall in Rio de Janeiro and Sao Paulo in Brazil If the developing countries had infant and maternal mortality rates like those of Cuba 8 4 million children and 500 000 mothers would be saved annually In the cholera epidemic in Haiti Cuban doctors are treating almost half of the patients with a mortality rate five times lower than those being treated by physicians from other countries Cuban international medical cooperation has made it possible to save more than 4 4 million lives in dozens of countries in four continents Human dignity is a human right Today 1 4 billion people are living in extreme poverty There are 1 2 billion hungry people and a further two billion are suffering from malnutrition There are 759 million illiterate adults Mr President The Council has demonstrated its capacity for approaching human rights situations in the world including those of an urgent nature which require attention and action on the part of the international community The usefulness of the Universal Periodic Review as a means of sustaining international cooperation of evaluating the undertakings of all countries without distinction in this context has been confirmed The spirit which animated our actions during the review process of this body was to preserve improve and strengthen this Council in its function of effectively promoting and protecting all human rights for everyone The results of this exercise express a recognition of the Council s important achievements in its short existence While it is true that the agreements reached are insufficient in the light of the demands of developing countries the body has been preserved from those whose aim was to reform it to their convenience in order to satisfy hegemonic appetites and to resuscitate the past of confrontation double standards selectivity and imposition It is to be hoped from the debates of the last few days that this Human Rights Council will continue constructing and advancing its development as an institution toward the full exercise of its

    dispense with the bourgeois illusions whose tentacles succeeded in confusing many students when they were least experienced and most passionate This would be a subject for a long and endless discussion Lenin the founder of the Communist Party was another genius of revolutionary action That is why I did not hesitate for a single second when at the trial after the attack on the Moncada which I was allowed to attend just one time I stated before the judges and dozens of high ranking officers of the Batista regime that we were readers of Lenin s works We did not talk about Mao Zedong because the Socialist Revolution in China inspired by identical purposes had not yet concluded But I should note however that revolutionary ideas are to be always on the alert as humanity is able to multiply its knowledge Nature has taught us that tens of billions of light years may have passed by but life in any of its forms will always be subject to the most incredible combinations of matter and radiations The personal greeting between the Presidents of Cuba and the United States took place at the funeral of Nelson Mandela a notable and exemplary fighter against Apartheid who was a friend of Obama s Suffice it to say that already by that moment several years had elapsed since the Cuban troops had dealt a devastating defeat to the racist army of South Africa led by a rich bourgeoisie that was the owner of huge economic resources That is the history of a struggle that is still to be written South Africa the government with the most financial resources in that continent had nuclear weapons that had been supplied by the racist State of Israel by virtue of an agreement between the latter and President Ronald Reagan who authorized it to deliver the devices required for the use of such weapons with which South Africa could attack the Cuban and Angolan forces that were defending the People s Republic of Angola against the occupation of that country by the racist thus excluding every possibility of negotiating peace while Angola was being attacked by the Apartheid forces with the best trained and equipped army in the African continent Under such circumstances there was no possibility whatsoever for a peaceful solution The ceaseless efforts made to crush and systematically bleed out the People s Republic of Angola with the power of that well trained and equipped army was the determining factor behind Cuba s decision to deal an overwhelming blow against the racists in Cuito Cuanavale a former NATO base which South Africa was attempting to occupy at all costs That arrogant country was forced to negotiate a peace agreement which put an end to the military occupation of Angola and to the Apartheid regime in Africa The African continent was then free from nuclear weapons Cuba had to face for the second time the risk of a nuclear attack The Cuban internationalist troops withdrew from Africa
